COVID-19 UPDATE EMAIL/DOB Re: Recently Issued Disapprovals by the Dept of Previously Approved Work:  

Following the guidance issued by ESDC which broadened the parameters of essential construction, on April 15th you were informed of certain scopes of work that could be submitted through the Essential Construction portal, and the parameters of what was allowed within those work types.  This included work necessary to protect the safety of occupants, work in support of an essential business, and work limited to a single worker.  Following audits of this work by the Department it was determined that a number exceeded what was allowed for in the guidance and as a result emails were sent to applicants informing them that their approval is no longer valid.  Applicants have the option to resubmit for approval, during which time work must not continue.

In addition, a number of Essential Construction Requests were approved to perform work to safely shut down and secure sites following the order to suspend non-essential construction on March 20, 2020.  This work should now be complete.  Therefore, any approvals for such work have now lapsed.  Those applicants who received approvals for make-safe work have received an email with more information, including direction to suspend construction operations in accordance with Buildings Bulletin 2020-006.  If such work needs to continue, applicants can resubmit for approval, during which time work can not continue.

NYC DOB has provided the following documents clarifying the updated guidance released by the Empire State Development Corporation (ESDC) on 4/14/20 related to essential and nonessential construction: 


The Department of Buildings issued Industry Best Practices for Physical Distancing Guidelines for Construction Sites.  Additionally, NYC DOB has issued guidance stating that, in, an effort to minimize walk-up traffic to DOB offices, Effective Tuesday, April 7, 2020, Certificate of Correction documents and Temporary Certificate of Occupancy (TCO) payments must be submitted online.
